We have decades-long experience and provide legal services in wide fields of real estate law. We have been involved in concluding hundreds of property sale-purchase agreements and conducting land development or adjustment procedures. Accordingly, our colleagues have up-to-date knowledge of the legal requirements and judicial practice applicable to real estate transactions.
In addition to property sale and purchase agreements as well as lease agreements, our services include legal advice and drafting of documents related to the preparation and completion of real estate development projects, issues related to the utilization and alienation of certain national assets, the comprehensive implementation of related pre-competition procedures, and complex legal expert activities related to real estate development procedures and town planning processions.
Real estate contracts
Our services include the management of property transfer contracts such as sale and purchase agreements, gift contracts, exchange contracts and real estate contributions. We provide full legal support for the property transaction, from legal advice on the contractual form that best serves our clients’ business objectives – while optimizing the level of public dues incurred – through drafting the given contract to providing legal representation in the land registration procedure. We work closely with our clients to develop the content of the applied contract and any specific solution that may be required, especially in the case of complex transactions or those financed by bank loans or using other external sources.
In cases requiring a lawyer’s countersignature, we offer the possibility of concluding the contract outside the office, by means of a remote signature, provided that the applicable conditions are met. In such case the personal presence of our clients during contracting is not required.
We also prepare lease agreements and other likewise contracts regarding both private properties and part of national assets as well, like municipal-owned properties.
Our colleagues can also assist with other specialized legal issues relating to real estate, such as enforcement proceedings, the transfer of field-land under the Land Transfer Act or providing legal representation in litigation involving real estate.
National assets - state-owned or municipal properties
We have considerable experience in the preparation and implementation of mandatory pre-competition (bidding) procedures of sale and utilization of national assets, and in optional cases as well, where our clients aim to increase the purchase price or the amount of the lease. Our services include preparing a timetable for the tendering procedure, the draft of an advertisement if required, the rules of the applicable tendering procedure, drafting the related documents, handling the emerging questions and answers, examining the validity of the bids received and providing legal expertise for the evaluation of the bids if required. We undertake the full organization and management of oral tenders as well.
Construction projects
We provide full legal support throughout the planning and implementing phase of construction projects. This involves cooperating closely with our investor clients, to draft the design contract and the construction contract. We also provide legal advice on issues arising during investment projects, such as late or defective performance, the conditions for the application of penalties, or the enforcement of repair obligations under warranty and liability for defects. In the case of an investor that is a public contracting authority, the above tasks are carried out in accordance with the relevant documents of the public procurement procedure, in cooperation with the public procurement expert or consultant on the commission, and in compliance with the legal requirements applicable to public procurement.
Land development, lot line adjustment, urban planning - building regulations
We undertake the comprehensive legal management of land development procedures related to the building regulations of municipalities. During urban planning, the land development procedure allows for changes to be made to the details of the properties affected by lot line adjustment, in particular to the floor area and layout, taking into account the relevant building regulations. During that, it is possible either to carry out a separate land development authorization procedure, or, in the case of a combined land development procedure, to directly submit the changes to the land register after the authorization procedure. Our activities include the whole-scale aspects of land development procedures, in particular, the interpretation of the content of the relevant local and national building regulations and other urban planning instruments, the preparation of land survey plans, representation in the official authorization procedure, drafting the land development agreement and representation in the land registration procedure.
